The following terms are used in these Terms and Conditions:
- Client: A person or organization commissioning design services.
- Designer: A self-employed individual or subcontracted professionals providing design services.
- Services: Conceptual garden design, including visualisations, 2D/3D plans, and material suggestions related to external space design. The Services are offered in three tiers:
- Basic: Includes 4x rendered images of an empty garden without vegetation, furniture, or decorative elements. Only the garden layout is shown.
- Advanced: Includes everything from the Basic tier, plus:
- A garden plan with dimensions in both color and black and white.
- 4x Rendered images with examples of vegetation, furniture, and garden decor. These are illustrative and not exact representations.
- Premium: Includes everything from the Advanced tier, plus:
- A detailed plan with descriptions of materials.
- Separate drawings of important garden elements with precise dimensions.
- A list of materials used in the design and their quantities.
- An up to 30-second animation showcasing the garden design.
- 4x Nighttime rendered images .
- Materials: Any visual elements, such as plans, drawings, images, or material lists, provided as part of the Services.
- Terms and Conditions: This document outlining the agreement between the Designer and the Client.
- Prices: All prices listed on the website apply to gardens up to a maximum of 100 m² . Larger gardens are priced individually. The price depends on the complexity of the project.
3. Scope of Services
- The Designer provides conceptual garden design services as defined above.
- These services are strictly conceptual and are not architectural or construction designs that comply with building regulations.
4. Prices and Payment Terms
1. Pricing:
- Prices for the Services are provided in GBP.
- Pricing is determined based on the tier of service chosen by the Client.
2. Payments:
- An initial fee of £100 applies to all plans, providing you with a simple garden concept for your approval.
- The Client must pay the full agreed fee upfront before the Designer begins work on the project.
- The payment confirms the Client’s agreement to the Terms and Conditions.
3. Refunds:
- If the Client cancels the project before the Designer starts work, the full fee will be refunded.
- If the project has already commenced, no refunds will be issued.
5. Client Protection and Guarantees
1. Scope of Work:
- The Designer commits to providing the agreed-upon deliverables as detailed in the project agreement.
- A detailed project description, including timelines and outputs, will be provided to the Client prior to payment.
2.Transparency:
- The Client will receive updates on project progress if the work extends beyond agreed time.
- The Designer will communicate any potential delays or adjustments to the agreed timeline.
3.Portfolio Use:
- The Designer may include the final project in their professional portfolio, unless the Client requests confidentiality in writing.
4. Dispute Resolution:
- In the unlikely event of dissatisfaction, the Designer commits to discussing revisions or adjustments within the scope of the initial agreement to meet the Client’s expectations.
6. Project Timelines
1. The project completion time is communicated via email and agreed upon by the client.
2. Delays caused by the Client, such as failure to provide necessary information, may extend the timeline.
7. Intellectual Property
- The Designer retains all intellectual property rights to the designs and materials provided, unless explicitly agreed otherwise in writing.
- The Client may use the designs solely for their intended purpose, such as garden implementation.
- Any reproduction, modification, or reuse of the designs requires the Designer’s written consent.
8. Data Protection
- The Designer processes Client data in compliance with UK GDPR and the Data Protection Act 2018.
- Personal data will only be used for delivering the Services and will not be shared with third parties, except where required by law.
9. Liability and Limitation of Responsibility
- The Designer’s services are conceptual and serve as a visualization of proposed land use. They are not architectural or construction projects and should not be treated as technical documentation under applicable building regulations.
- The project does not include detailed technical analyses, such as soil load-bearing capacity, material strength, water and ground conditions, or underground infrastructure. It is strongly recommended to consult qualified professionals, such as architects, structural engineers, or surveyors, before proceeding with any construction work or purchasing materials.
- The Designer is not responsible for:
- Any damages arising from improper execution of works by contractors.
- Non-compliance of the project with technical standards or local building regulations.
- Modifications introduced by the client or contractor that may affect the final outcome of the project.
- Unforeseen site challenges, such as underground utilities, not disclosed or identified before the design process began.
- Any visual elements included in the project, such as materials, plants, or furniture, are for illustrative purposes only and may not reflect actual dimensions, colors, or specifications.
- The ultimate responsibility for ensuring compliance with local building codes, selecting materials, and determining construction methods lies with the contractor and the client.
- The Designer’s liability is limited to the total fee paid by the Client for the Services.
10. Complaints Procedure
- Clients may submit complaints regarding the Services via email to: info@click-garden.co.uk.
- The Designer will respond to complaints within 7 working days.
- If the Client and Designer cannot resolve the complaint, the Client has the right to refer the matter to an Alternative Dispute Resolution (ADR) provider.
11. Governing Law
- These Terms and Conditions are governed by the laws of England and Wales.
- Disputes arising under these Terms will be resolved in the courts of England and Wales.
12. Updates to Terms and Conditions
- The Designer reserves the right to amend these Terms and Conditions.
- The latest version will be available upon request and provided to Clients before engaging in new Services.
13. Trust and References
- The Designer may provide references or examples of previous work upon request to help the Client make an informed decision.
- By paying the agreed fee, the Client acknowledges they have reviewed the Designer’s portfolio and agree to the style and quality of the Services provided.
14. Materials and Dimensions
1.The materials and dimensions provided in the project are intended as guidelines and may differ slightly from the final implementation.
Variations can occur due to material availability, contractor adjustments, or practical considerations during execution. These variations are
typically minor and do not affect the overall design intent.
